Conditions of Entry

1. The Entrant/Parent/Guardian of the Entrant named overleaf, in consideration of the acceptance by Byron Bay Winter Whales and Byron Bay Surf Lifesaving Club of my entry in the 2023 Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash consent and agree:To receive such medical or other treatment which may be deemed to be advisable by the Club, its medical and first aid assistants, beach or water safety patrol personnel, in the event of injury accident and/or illness during the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash.
2. To accept full responsibility to inform myself/ourselves and assess all the dangers hazards and risks of entry in the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash and rely/relies solely on my/our own assessment of these dangers, hazards and risks before participating in the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash and notwithstanding any decision thereon made by the Club and other persons, corporations and bodies involved/engaged in promoting or staging the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash (“the Organisers”).
3. To permit free use by the Club and the Organisers of my/our name and photograph in any broadcast, telecast or other media as may pertain to the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash.
4. To have sole responsibility for my/their/our personal possessions and equipment during the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash.
5. If, in the opinion of the surf life saving club, the weather or swimming conditions are dangerous or unsuitable, the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash may be cancelled without notice.
6. I acknowledge and agree that should the event be cancelled or postponed at any time before the start, the course is closed; that no event support or water safety will be provided by the Club or Organisers for any person/s deciding to swim in or about the course after cancellation or postponement; that any such activity is entirely at a swimmer’s own risk; and that no responsibility will be taken by the Club or the Organisers for any injury or misadventure arising from such activity
7. That, in the event of cancellation of the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash, my/their entry fee shall not be refundable.
8. That it is a term and condition of my/our engagement in the Byron Bay Property Sales Ocean Swim Classic and or, the Byron Bay Chocolate Co Dash that I/we enter at my/our own risk and such terms and conditions shall include any liability that results from breach of an express or implied warranty that the services of the Club and the Organisers will be rendered with reasonable care and skill.
9. That the terms and conditions contained in this entry form shall be construed broadly to provide a release, indemnity and waiver to the Organisers of any liability for loss injury or other damage to personal property to the maximum extent permitted by law and shall be construed according to the law of New South Wales.
